In accordance with the parameters stated in Utah law, none of the below topics are to be addressed or elicited in the curriculum, surveys, of children in the state of Utah without written parental consent (Utah Code 53E-9-203).
USBE Rule R277-217(2)(23j and 24) an educator may not: Encourage a student to develop a prejudice on the basis of sexual orientation or gender identification [or]… knowingly or intentionally permit unauthorized collection sharing or use of student data.
R277-217(3)(b) an educator shall maintain appropriate verbal emotional and social boundaries.
Utah state code 53e-9-203(1)(c) Activities prohibited without prior written consent–
Policies adopted by a school district or charter school… shall include prohibitions on the administration to a student of any psychological or psychiatric examination, test, or treatment, or any survey, analysis, or evaluation without the prior written consent of the student’s parent, in which the purpose or evident intended effect is to cause the student to reveal information, whether the information is personally identifiable or not, concerning the student’s or any family member’s … sexual behavior, orientation, or attitudes.
